A stay of execution

Anthony Marshall gets another day of freedom

Anthony Marshall, the 89-year old son of the late philanthropist Brooke Astor, got a one day stay of execution from Judge A. Kirke Bartley this afternoon.

Marshall, a former CIA intelligence officer, ambassador and theatrical producer, was convicted in 2009 of looting millions of dollars from his mother as her mind failed. He was not in court today to hear this news but his co-defendant and former family lawyer, Francis X. Morrissey Jr., was told that he would be taken off to serve his sentence.

Justice Bartley announced that Morrissey, 70, would be housed in either protective custody or a prison medical unit and told him to stand and place his hands behind his back. The disgraced lawyer was led away through a side door of the courtroom by four court officers and is expected to serve between one and three years.

Mr Marshall, whose representatives continue to argue that sentencing him to a spell in a prison would be “cruel”, is summoned once again tomorrow. We expect he’ll turn up in a wheelchair with his third wife, Charlene (whom the New York Post’s Andrea Peyser somewhat cruelly calls “Miss Piggy”), but doubt that he’ll find a way to avoid jail this time.
